Between the submittal of the captioned article on ADHC/Elderday and its publication in the spring edition of "The Rural Health Advocate", several developments occurred which appear to have improved the chances of continued survival of ADHCs, at least for the present. They are as follows:
- On February 24, 2010 a federal court issued a preliminary injunction against the proposed new medical necessity criteria for enrollment at all ADHCs in California, on the basis that the criteria violated the federal Americans with Disabilities Act. Absent the injunction, the criteria would have become effective March 1, 2010.
This was the second federal court injunction against the 2009 trailer bill language described in the initial article. The first injunctive order blocked the reduction of reimbursement days from 5 to 3, also on the basis that the reduction violated the ADA.
- On February 18, 2010 Assemblymember Bonnie Lowenthal (D, 54th AD, Long Beach) introduced AB 2073, “Medi-Cal: adult day health care services,” a bill which would conform the proposed new ADHC medical eligibility criteria to federal law.
- Statewide pro-ADHC advocacy efforts forced legislators to postpone a vote on the Governor’s requested elimination of ADHC funding until the next fiscal year, beginning July 1, 2010.
